Terms of Service

The service

TopPosition is an independent public position board. It is a self-promotion display service: each successful payment of the fixed price makes the person who paid the current #1 position, showing their name and optional photo. The next successful payment by anyone moves the #1 position to that person. The price is the same for everyone; it is not an auction or bidding service. The “times #1 has been taken” counter counts all confirmed payments; it is not a price. Daily history is grouped by UTC calendar day. A listing or rank is not an endorsement by anyone named or shown on the site.

Prices and payments

• The fixed price to take #1 is shown before you pay, in your local currency where supported. In India it is ₹1.
• The price shown at checkout is the amount we charge. Your bank or card issuer may add its own fees, such as currency conversion charges.
• Payments are processed by our payment partner, Cashfree Payments. We do not see or store your card, bank, or UPI details.
• You become #1 only after the payment partner confirms the payment. If a payment fails or is cancelled, nothing is recorded.
• Refunds are covered by the Refund & Cancellation Policy.

Eligibility

• You must be at least 18 years old, or have permission from a parent or guardian, to make a payment.
• Use the site only if doing so is legal where you live. Payments are not available in some countries.

Your public profile and content

A display name is required; a profile photo is optional. Your name, username, photo, and the times you reached #1 are shown publicly on the position card, position history, and your shareable profile page. Submit only a name and photo that you own or are allowed to use. You keep ownership of your photo and allow us to display it on the site for as long as it is part of your profile.

Acceptable use

• Do not impersonate anyone, harass or defame others, upload obscene, hateful, misleading, or unauthorised images, or break the law.
• Do not interfere with the site, its payments, or other users, or try to reach #1 without paying.
• We may hide or remove a name or photo, or block an account, that breaks these terms or the Rules. Payments already made are not refunded in that case.

Independence

TopPosition is independent and is not affiliated with or endorsed by any public figure, government, or political organisation.

Availability and liability

We work to keep the site available but do not promise it will always be online or error-free. To the extent allowed by law, our total liability to you for any claim is limited to the amount you paid us in the 30 days before the claim. Nothing in these terms removes rights you have under consumer protection law that cannot be limited.

Governing law and changes

These terms are governed by the laws of India, and the courts at Hyderabad have jurisdiction. We may update these terms; the date at the top shows the latest version, and changes apply to payments made after that date.
